Two men described as associates of the Akasha family, including a businessman linked to the luxury car trade, were arraigned before the Kibera Law Courts today to answer to charges of threatening to kill and causing grievous bodily harm.
Rahiel Daud and Hitesh Motwani, alias Vicky—an employee of Executive Car World—appeared before Senior Principal Magistrate Zainabu Abdul. The duo pleaded not guilty to two counts stemming from a violent confrontation earlier this week.
The prosecution told the court that on March 25, 2026, at the Taal Club in Westlands, the accused threatened to kill Arya Anuj without lawful excuse. In a second count, the court heard that at the same time and location, the pair physically assaulted Anuj, occasioning him significant bodily harm.
Beyond the immediate charges, the duo is also allegedly under investigation for separate involvement in fraud and extortion rings.
The defense, while denying the charges, moved the court to release the accused on lenient bond terms, arguing that they are not flight risks and are willing to comply with all court conditions.
“Your honor, we pray for the release of the accused persons on lenient cash bail since they are not a flight risk,” the defense counsel pleaded.
The prosecution did not strictly oppose the bond application but urged the court to prioritise the gravity of the “threatening to kill” charge. The state further requested a probation report to assess the duo’s standing in society and a court order barring them from leaving the jurisdiction of the court.
Before the plea was taken, the defence attempted to defer the proceedings, claiming the accused were forced to record statements under duress “behind a building” at the Capital Hill Police Station. They also questioned whether the charges met the necessary prosecution threshold.
However, Magistrate Abdul dismissed the push for deferment, clarifying that charge sheets are only presented after the Office of the Director of Public Prosecutions (ODPP) has reviewed investigators’ files and deemed the evidence sufficient for trial.
Magistrate Abdul directed that the accused be detained at the Parklands Police Station until Monday, March 30, 2026. The court will then review a pre-bail report before making a final determination on bond terms.
